All-Risk Insurance vs. Named Peril Policy: What is the difference?

All Risk InsuranceAl-lrisk insurance or a named peril insurance policy, which is better in a given situation?

Basically, insurance companies write two types of policies for homeowners and small businesses: named peril and all risk (all-risk is also known as an open peril policy or a comprehensive).

What’s the Difference?

The “named peril” insurance policy covers only what is specifically mentioned in the policy.  If the policy says it doesn’t say you’re covered for vandalism damages or backed up sewers, you are not covered. The named peril insurance policy only covers specific perils, so it is usually less expensive than an all-risk or open peril insurance policy.

A typical named peril policy would cover fire, windstorm, hail, aircraft, riot, vandalism, explosion and smoke. Flood insurance and earthquake insurance are two other common examples of named peril policies, and are generally written as separate policies.   When coverage is written as a named peril basis, the burden is on you, the insured, to prove that one of the named perils caused the loss.

An “all-risk” or open peril policy covers everything that is not specifically excluded in the insurance policy. The all-risk insurance policy usually costs more than the named peril policy because it offers more comprehensive coverage. Also, under an all-risk policy, the burden is not on you, but on the insurance company, to prove that the peril causing the damage is not excluded; if it’s not excluded then coverage applies. The exclusions and limitations are the key to determining what coverage is provided by an all-risk policy.

The most common perils excluded in an all-risk policy include:

•War

•Flood, mudslide, seepage & sewer backup (and sometimes surface water that builds up after heavy rains, underwater springs, groundwater, burst water pipes, overflowing toilets, and wind or wave-driven water)

•Governmental seizure or destruction of property

•Boiler explosion

•Off-premises utility service interruption

•Building ordinance or law

•Seepage or leakage of water over a period of time

•Electrical damage to electrical devices

•Employee dishonesty

•Wear and tear; rust, corrosion, fungus, decay, deterioration, hidden or latent defect smog; settling, cracking, shrinking, or expansion; nesting, infestation or release of secretions by insects, birds, rodents or animals

•Damage to building interiors by rain, snow, sleet, ice, sand, or dust unless the roof or walls are first damaged – except damage by thawing of snow, ice or sleet

•Mechanical breakdown

•Theft of building materials and supplies not yet attached to buildings

•Pollution

•Earthquake or earth movement

So which insurance is the better choice?

If you are paying a mortgage, it is unlikely that you will have a choice. Most lenders require that you carry a comprehensive policy to protect their investment.

For all others, the type of insurance to purchase should be based on your needs depending on the type of property you have and your. The advantage of an all-risk policy is that it covers you in the event you have a loss that you did not predict. Even though all-risk policies may cost you  a little more, in a world where freak accidents happen, the broader your insurance coverage protection, the better off you will probably be. Just be sure to read the fine print so that you are clear about the stated exclusions.

As a new Texas resident, you have 30 days to “drive legal in Texas” by registering your vehicle and getting your Texas driver’s license.

Drive Legal in TexasBefore you register your vehicle, though, it must pass the state inspection process. And before you get an inspection, you must purchase Texas auto insurance.

Here are the four steps to follow:

1. Purchase Texas Auto Insurance.  State minimum requirements are $30,000 bodily injury liability per person/$60,000 per accident and $25,000 property damage liability

2. Take your vehicle to a local state inspection station. Find a list of what types of inspections are required in your county (plus an inspections-station locator) at the Department of Public Safety Web site.  Make sure you take your current driver’s license and proof of insurance.  You will need to show proof that you carry the minimum coverage required by the state: $30,000 bodily injury or death to one person; $60,000 bodily injury or death to two or more persons; and $25,000 injury or destruction to other property.

3. The inspection station will give you a verification form to bring to the county tax assessor-collector’s office when your car passes the inspection. Here  you will obtain a Texas vehicle registration sticker and license plates. You’ll need proof of ownership, such as registration or title from your previous home state, as well as proof of your insurance.

4. Then apply for a Texas driver’s license at the Texas Department of Public Safety (DPS) office in your area. Make sure to bring an ID, proof of Social Security number, proof of liability insurance, and proof of Texas vehicle registration. Expect to provide a thumbprint and surrender any valid out-of-state license you currently have.

Gap InsuranceIt will cover the difference between what your car is worth and what you still owe on the car.  If your car is totalled to the point that repair costs are more than the car is worth, or if it’s stolen, gap insurance covers the difference between the market value of the vehicle and your outstanding loan.

How does gap insurance work?

Let’s say you buy a new car for $20,000 and it’s involved in an accident and totalled.
Your insurance company will determine the value of your vehicle at the time of the loss and they will only pay you that amount less your deductible.

If the market value is less than the amount that you still owe on the car, gap insurance would pay the difference between what collision insurance covers and what you owe on the car. If you did not have gap insurance, the extra would come out of your pocket. (Also, if your insurance company determines that your deductible applies, that money will come out of your pocket,  gap insurance won’t cover it.)

Gap coverage for lessors:

If you are leasing a vehicle, even though you aren’t buying it outright, you are still responsible for the cost of the car if it is stolen or totalled.  Because lease payments are significantly lower, the difference between what you have paid and the value of the car can be huge, so gap insurance is much more critical for a lease and many  lease contracts require it.

Gap insurance for buyers:

For buyers, this will only be necessary if you expect to owe more on the car than what it’s worth.  If you made a low down payment, or if you bought a car that depreciates quickly, or if you have a high interest rate or if you rolled over other costs, like money owed on a trade-in into your new-car payments, having gap insurance makes alot of sense.  Most buyers, however, especially those who made a high down payment, will always be right-side-up on the car, and therefore they don’t need the extra coverage.

Who should buy gap insurance?

If you are leasing a car or you expect to owe more than your car is worth for a significant amount of time, you should consider purchasing this valuable coverage.

Who should not buy gap?

If you have arranged your down and monthly payments to make sure you will not be “upside down” on your loan for any significant period of time, there is no need to buy it.
